When you use the AI-powered services provided by Technologies Bernli Inc. (“AI Products”), you warrant that you will comply with this Policy, our Legal Terms, and all laws applicable to your use of the Services in Canada, including privacy, cybersecurity, consumer protection, advertising, anti-spam, intellectual property, criminal, and other applicable requirements. Your use of our AI Products signifies your agreement to engage with our platform in a lawful, ethical, and responsible manner that respects the rights, privacy, safety, and dignity of all individuals. If you do not agree with this Policy or the Legal Terms, please refrain from using our Services. Your continued use of our Services implies acceptance of this Policy and the Legal Terms.

We are Technologies Bernli Inc. (“Company,” “we,” “us,” or “our”), a company registered in Canada at 3-396 boulevard de la cité, Gatineau, Quebec J8T 8A1. We operate the website https://www.bernli.ca (the “Site”), as well as any other related products and services that refer or link to this Policy (collectively, the “Services”).
USE OF THE SERVICES
When you use the Services, you warrant that you will comply with this Policy, the Legal Terms, and all laws applicable to your use of the Services in Canada.
You also acknowledge that you may not:

Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

Make any unauthorized use of the Services, including collecting usernames, email addresses, personal information, or other identifiers of users by electronic or other means for the purpose of sending unsolicited messages, commercial electronic messages, or other communications that do not comply with Canada’s anti-spam rules, or creating user accounts by automated means or under false pretenses.

Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.

Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.

Make improper use of our Services, including our support services or submit false reports of abuse or misconduct.

Engage in any automated use of the Services, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

Interfere with, disrupt, or create an undue burden on the Services or the networks connected to the Services, including by bypassing rate limits, subscription tiers, usage caps, or technical protections.

Attempt to impersonate another user or person or use the username of another user.

Use any information obtained from the Services to harass, abuse, threaten, exploit, discriminate against, dox, stalk, or harm another person or group.

Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.

Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services, except as expressly permitted by applicable law.

Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.

Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.

Delete the copyright or other proprietary rights notice from any Content.

Copy or adapt the Services’ software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.

Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.

Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).

Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or using or launching any unauthorized script or other software.

Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.

Use the Services in a manner inconsistent with applicable Canadian law, this Policy, or the Legal Terms.

Collect, use, disclose, upload, or otherwise process personal information through the Services without required authority, consent, notice, safeguards, retention limits, or other measures required by Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable to Quebec users or operations, Quebec privacy-law requirements such as transparency, confidentiality-incident handling, and privacy-impact assessment obligations.

Upload, transmit, or use the Services to disclose confidential information, trade secrets, security credentials, payment data, health information, government identifiers, or other sensitive information unless you have authority to do so and appropriate safeguards are in place.

Use the Services to send, generate, facilitate, or target unsolicited commercial electronic messages, address harvesting, consent evasion, misleading sender information, or other conduct that does not comply with Canada’s anti-spam requirements.

Use the Services to create, distribute, or facilitate false, misleading, deceptive, or unfair marketing, advertising, pricing, endorsements, reviews, claims, or other representations.

Use the Services to create, host, upload, transmit, solicit, or facilitate unlawful, harmful, exploitative, or abusive content, including child sexual abuse or exploitation material, non-consensual intimate images, threats, harassment, hate, incitement of violence, terrorist or extremist content, or instructions for self-harm or serious harm to others.

Use the Services to infringe, misappropriate, or violate intellectual property, publicity, personality, privacy, moral, or other proprietary rights.

Use the Services for fraud, identity theft, phishing, scams, unauthorized financial activity, money laundering, sanctions evasion, or other deceptive or unlawful commercial activity.

Use the Services to develop, distribute, test, or facilitate malware, ransomware, credential theft, vulnerability exploitation, unauthorized access, denial-of-service attacks, security circumvention, or other cybersecurity abuse.

Use bots, scripts, scrapers, crawlers, automated accounts, data mining, load testing, benchmarking, or similar methods to access, extract, monitor, copy, overload, or interfere with the Services except where expressly authorized by us in writing.

Rely on AI Products or AI outputs as a substitute for professional, legal, financial, tax, medical, safety, or other regulated advice, or use AI outputs to make decisions with legal, financial, employment, housing, credit, insurance, health, immigration, or other significant effects on individuals without appropriate human review, validation, transparency, and compliance with applicable Canadian law.
Subscriptions
If you subscribe to our Services, you understand, acknowledge, and agree that you may not, except if expressly permitted:

Use the Services for any illegal purpose or in violation of applicable Canadian law, including fraud, money laundering, sanctions evasion, or unauthorized financial activities.

Reconstruct or attempt to discover any source code or algorithms of the Services, or any portion thereof, by any means whatsoever.

Provide, or otherwise make available, the Services to any third party.

Intercept any data not intended for you.

Damage, reveal, or alter any user’s data, or any other hardware, software, or information relating to another person or entity.

Reverse engineer, decompile, disassemble, or attempt to discover source code, algorithms, or underlying components of the Services.

Intercept, access, or disclose data not intended for you from the Services or third parties.

Damage, disable, overburden, impair, or interfere with the Services or any users’ use or enjoyment thereof.

Exploit bugs, errors, vulnerabilities, or unintended functionality (including but not limited to generating excessive AI tokens, unlimited receipt processing, or exceeding fair usage limits).

AI Products

When you use the AI Products provided by Technologies Bernli Inc., you warrant that you will not:

Use AI Products to deceive, manipulate, exploit, or materially impair a person’s ability to make an informed decision, including by generating dark patterns, impersonation, coercive messaging, or other deceptive practices that may cause harm.

Use AI Products to exploit vulnerabilities related to age, disability, socio-economic circumstances, language, health, dependency, or other personal characteristics in a way that may cause harm, discrimination, or unfair treatment.

Use AI Products to identify, profile, categorize, or make inferences about individuals based on biometric information or sensitive personal information unless you have a lawful basis, appropriate consent or authority, and safeguards required by applicable Canadian privacy and human rights laws.

Use AI Products to evaluate, rank, or classify individuals or groups in a manner that is unfair, discriminatory, materially misleading, or likely to cause unjustified denial of access to services, opportunities, or benefits.

Use AI Products to assess criminal, security, credit, employment, housing, insurance, immigration, health, or other significant risks about an individual based solely on profiling or sensitive characteristics without lawful authority, appropriate human review, validation, and safeguards.

Compile biometric, facial-recognition, or identity datasets through scraping, covert collection, or other collection of images, recordings, or identifiers from the internet, social media, CCTV, or similar sources unless you have lawful authority and comply with applicable Canadian privacy, consent, transparency, and safeguarding requirements.

Use AI Products for real-time or remote biometric identification, tracking, or surveillance of individuals in public or private spaces unless you have lawful authority, appropriate notice and consent where required, proportional safeguards, and compliance with applicable Canadian law.
This Policy applies to all AI-powered features, services, and systems in our Services. It governs the permitted and prohibited use of AI technologies through the Services, helps protect users’ rights and privacy, and supports transparency in AI-related interactions. This Policy applies to users and, where relevant, to employees, third-party vendors, and partners who contribute to or interact with our AI Products.
- Improper handling, storage, disclosure, retention, or use of data through AI Products, including conduct that may create a privacy breach, confidentiality incident, security incident, or non-compliance with applicable Canadian privacy requirements.
We recognize the significant impact AI can have on our users and society, and we are dedicated to designing and operating our AI Products in a responsible, privacy-protective, secure, and accountable manner appropriate for our Services. We aim to use AI to enhance user experiences while supporting fairness, transparency, human oversight, and compliance with applicable Canadian law.
This Policy applies to all AI-powered features, services, and systems in our Services. It governs the permitted and prohibited use of AI technologies through the Services, helps protect users’ rights and privacy, and supports transparency in AI-related interactions. This Policy applies to users and, where relevant, to employees, third-party vendors, and partners who contribute to or interact with our AI Products.
Enforcement
Any misuse of our AI Products or failure to adhere to the standards outlined in this Policy may result in appropriate actions to ensure the integrity of our platform and the protection of our users. The specific consequences for misuse of AI may vary depending on the nature and severity of the violation and the user’s history with our Services.
Violations may include, but are not limited to:

Engaging the AI Products in ways that violate user privacy, manipulate data, disregard this Policy, or breach applicable AI service-provider terms of use.

Deploying AI in a manner that introduces or causes bias, discrimination, unfair treatment, privacy violations, or harmful outcomes for users or groups.

Improper handling, storage, disclosure, retention, or use of data through AI Products, including conduct that may create a privacy breach, confidentiality incident, security incident, or non-compliance with applicable Canadian privacy requirements.

Using AI in a way that compromises the privacy, confidentiality, security, integrity, or availability of our systems, data, or users.
Depending on the violation, Technologies Bernli Inc. may take one or more of the following actions:

Warnings: The responsible party may receive a formal warning and be required to cease violating practices.
-
Temporary Suspension: In cases of repeated or more severe violations, the responsible individual’s access to AI Products or certain features of our platform may be temporarily suspended while the issue is investigated.

Termination of Access: Serious violations, particularly those that result in harm to users or breach privacy, security, or other applicable Canadian legal requirements, may lead to the permanent termination of access to our AI Products and Services.

Legal Action and Reporting: In cases where misuse of AI leads to significant harm, a privacy or security incident, or legal violations, we may pursue legal action against the party responsible and may report the incident to law enforcement, privacy regulators, cybersecurity authorities, affected organizations, or affected individuals where appropriate or required by applicable Canadian law.

Transparency and Remediation: For serious incidents, we may take reasonable steps to investigate, contain, mitigate, document, and communicate about the incident in a manner consistent with our Legal Terms, privacy notices, contractual commitments, and applicable Canadian law.
Commitment to Responsible AI
In addition to the consequences outlined above, we are committed to taking reasonable steps to reduce and address foreseeable harm from misuse of AI Products. We may investigate reported issues, adjust safeguards, correct or remove problematic outputs where feasible, and implement additional controls to reduce recurrence.
At Technologies Bernli Inc., we are committed to the ongoing refinement and enhancement of this Policy. As technology evolves and Canadian legal and regulatory expectations shift, we recognize the importance of keeping this Policy relevant, effective, and aligned with responsible AI, privacy, security, and online-safety practices. We will review and update this Policy as needed to reflect technological developments, applicable Canadian legal requirements, and practical safeguards for our Services.
CONTRIBUTIONS
In this Policy, the term “Contributions” means:

any data, information, software, text, code, music, scripts, sound, graphics, photos, videos, tags, messages, interactive features, or other materials that you post, share, upload, submit, or otherwise provide in any manner on or through to the Services; or
-
any other content, materials, or data you provide to Technologies Bernli Inc. or use with the Services.
Some areas of the Services may allow users to upload, transmit, or post Contributions. We may but are under no obligation to review or moderate the Contributions made on the Services, and we expressly exclude our liability for any loss or damage resulting from any of our users’ breach of this Policy. Please report any Contribution that you believe breaches this Policy; however, we will determine, in our sole discretion, whether a Contribution is indeed in breach of this Policy.
You warrant that:

you are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Services, and other users of the Services to use your Contributions in any manner contemplated by the Services and this Policy;

all your Contributions comply with applicable laws and are original and true (if they represent your opinion or facts);
-
the creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party; and
-
you have the verifiable consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Services and this Policy.
You also agree that you will not post, transmit, or upload any (or any part of a) Contribution that:

is in breach of applicable laws, regulation, court order, contractual obligation, this Policy, our Legal Terms, a legal duty, or that promotes or facilitates fraud or illegal activities;

is defamatory, obscene, offensive, hateful, insulting, intimidating, bullying, abusive, or threatening, to any person or group;
-
contains unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, commercial electronic messages, address harvesting, or other forms of solicitation, including paid or incentivized content that is not clearly disclosed or does not comply with Canada’s anti-spam rules; or
-
includes child sexual abuse material, or violates any applicable law concerning child pornography or otherwise intended to protect minors;
-
contains any material that solicits personal information from anyone under the age of 18 or exploits people under the age of 18 in a sexual or violent manner;
-
promotes violence, advocates the violent overthrow of any government, or incites, encourages, or threatens physical harm against another;
-
is obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, contains sexually explicit material, or is otherwise objectionable (as determined by us);
-
is discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age;
-
bullies, intimidates, humiliates, or insults any person;
-
promotes, facilitates, or assists anyone in promoting and facilitating acts of terrorism;
-
infringes, or assists anyone in infringing, a third party’s intellectual property rights or publicity or privacy rights;
-
is deceitful, misrepresents your identity or affiliation with any person and/or misleads anyone as to your relationship with us or implies that the Contribution was made by someone else than you;
-
contains unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation that has been “paid for,” whether with monetary compensation or in kind; or
-
misrepresents your identity or who the Contribution is from.
REPORTING A BREACH OF THIS POLICY
We may but are under no obligation to review or moderate the Contributions made on the Services and we expressly exclude our liability for any loss or damage resulting from any of our users’ breach of this Policy.
If you consider that any Content or Contribution has been mistakenly removed, restricted, or blocked from the Services, please refer to the contact details at the bottom of this document and we will review our decision within a reasonable time. The Content or Contribution may remain unavailable while we conduct the review process.

We reserve the right to review, moderate, restrict, and remove any uploaded content (e.g., receipt photos) that violates our Legal Terms, this Policy, or applicable Canadian law. Prohibited Contributions include:

Content you do not own or have permission to upload or process (e.g., copyrighted material, confidential information, or personal information collected or disclosed without required authority).

Malicious, harmful, or illegal content (e.g., viruses, malware, fraud indicators, phishing material, child sexual exploitation material, non-consensual intimate content, hate or violent extremist content, or obscene images).
Spam, bulk or irrelevant uploads, automated submissions, scraping, rate-limit abuse, or attempts to abuse OCR or AI features (e.g., non‑receipt images or prompts designed to bypass safety controls).
Violations may result in content removal, account restrictions, suspension, or termination, with or without notice where permitted by the Legal Terms and applicable law. Appeals: Contact [email protected] with details. We may use automated tools (e.g., file scans) and manual review as needed. Users retain ownership of their Contributions but grant us the rights described in the Legal Terms to host, process, moderate, restrict, or delete Contributions as required to provide, protect, and enforce the Services.
The consequences for violating our Policy will vary depending on the severity of the breach and the user’s history on the Services, by way of example:
Technologies Bernli Inc. is under no obligation to monitor users’ activities, and we disclaim responsibility for any user’s misuse of the Services to the maximum extent permitted by applicable Canadian law. Technologies Bernli Inc. is not obligated to monitor or exercise editorial control over user Content or Contributions created, maintained, stored, transmitted, or accessible on or through the Services. If Technologies Bernli Inc. becomes aware that any Content or Contribution violates this Policy, Technologies Bernli Inc. may remove or restrict the Content or Contribution, block or restrict your account, preserve relevant information, and report the matter to Canadian law enforcement, privacy regulators, cybersecurity authorities, payment partners, affected organizations, or affected individuals where appropriate or required by applicable Canadian law. Unless otherwise stated in this Policy, Technologies Bernli Inc. disclaims any obligation to any person who has not entered into an agreement with Technologies Bernli Inc. for the use of the Services.
We exclude our liability for all action we may take in response to any of your breaches of this Policy.
